Welcome to sticky-nodes.com (the “Service”), a web application operated by Toomee Limited (“we,” “us,” or “our”). We are a creative studio based in the United Kingdom.

By creating an account, purchasing a license, or participating in a workshop on Sticky Nodes, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

• Age Requirement: You must be at least 18 years of age to purchase a license or create a user account.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities that occur under your account.
• Subscriptions: Access to workshop creation features requires a paid license. By purchasing a license, you authorize us (and our third-party payment processors) to charge the applicable fees.

• Prohibited Content: You may not use Sticky Nodes to create, upload, or distribute content that is illegal, defamatory, promotes hate speech, contains malware, or infringes on the intellectual property rights of others.
• AI Usage (Google Gemini): Our Service utilizes artificial intelligence (Google Gemini) for certain node functions.
• No Guarantees: You acknowledge that AI-generated responses may be inaccurate, inappropriate, or biased. Toomee Limited is not responsible for errors or hallucinations produced by the AI.
• Prohibited AI Use: You must not use the AI features to generate harmful, illegal, or sexually explicit content, or to attempt to "jailbreak" or manipulate the AI model.

• Our Content: The Sticky Nodes platform, including its code, design, "look and feel," logos, and pre-programmed node logic, is the intellectual property of Toomee Limited. You may not reverse engineer, copy, or reproduce the platform’s underlying software.
• Your Content (User-Generated Content): You retain ownership of the workshops, workflows, and specific text/media you input into the nodes (“User Content”).
• License to Toomee: By creating a workshop, you grant Toomee Limited a worldwide, royalty-free license to host, store, run, and display your User Content solely for the purpose of providing the Service to you and your participants.

This section applies where you (the "Creator") use Sticky Nodes to collect personal data from third parties ("Participants") during a workshop session.

• Roles: In relation to Participant data (e.g., names, occupations, locations submitted during a session), you act as the Data Controller and Toomee Limited acts as the Data Processor.
• Your Responsibilities: You warrant that you have a lawful basis (such as consent) to collect personal data from your Participants.

Our Responsibilities: Toomee Limited shall:

1. Process Participant data only to provide the Sticky Nodes service.
2. Ensure that persons authorized to process the data (e.g., Support Techs) are committed to confidentiality.
3. Implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk (including encryption and secure Google Cloud storage).
4. Delete live session data (Participant inputs and votes) from our active servers 24 hours after the session concludes, in accordance with our system design.

• Session Data Deletion: You acknowledge that data generated during live workshop sessions (Participant votes, inputs, text answers) is transient. We automatically delete this data 24 hours after the session ends. It is your responsibility to record any necessary results before this period expires.
• Workshop Storage: We retain your Workshop designs (layouts and node configurations) indefinitely while your account is active.
• Support Access: You agree that Toomee Support Technicians may access your workshop flows and database entries for the specific purposes of maintenance, debugging, and customer support.

Our Service runs on third-party infrastructure (Google Cloud, Firebase) and may contain links to external sites. We do not control these third-party services and are not responsible for their content or privacy practices.

The Service is provided on an “as is” and “as available” basis. Toomee Limited does not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by English law, Toomee Limited shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service, including but not limited to data loss (including the scheduled deletion of session data) or errors in AI-generated content.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you violate these Terms (specifically regarding acceptable use or payment obligations).

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
